Long Term Disability

Even after paying thousands of dollars in premiums to your insurance company, refusal to pay out a claimant is a common occurrence for short (STD) or long – term disability (LTD). This is in spite of the fact that you have a very real condition that prevents you from working. We can assist.

At Juzkiw Law, our team help clients understand their basic right with a sense of strong advocacy to secure the insurance benefits to which you are entitled.

Our experienced lawyers provide clients with ongoing communication in relation to their case which keeps up to date and engaged with their claim. The process begins at our initial free consultation and continues throughout every stage of advocating for a reconsideration, litigation, and settlement of a denied STD or LTD claim.

Meeting the Criteria for Short – Term and Long – Term Disability Benefits

Both short -and long- term disability benefits are generally paid out as part of a private insurance policy, and the specific terms of the benefits will be different depending on an individual’s coverage. In many cases short- and long-term disability insurers will pay benefits if a policy holder is unable to work due to a disability caused by a certain set of events. Some insurers require a claimant to apply for Canada Pension Plan Disability Benefits (CPPD) before initiating the application process for STD and LTD. At Juzkiw Law our team specializes in assisting clients with the application process.

At Juzkiw Law we view each through a unique lens, both in the circumstances of our clients and in their individual insurance policies. Quite often certain polices often exclude pre-existing illnesses, specific illnesses, psychological trauma and or physical trauma thus impeding entitlement. The date of a physical injury could be long in the past, but its cumulative effects can cause devastating emotional or psychological trauma debilitating enough to prevent the claimant from working. It is common for an insurer to pay benefits for a short period of time and then terminate them or pay benefits for period of time through a specific disability test and then terminate them for not meeting entitlement provisions for other tests of disability. The process is complicated and intense. At Juzkiw Law our team provides the legal expertise to provide effective communication while navigating you through the process to ensure your entitlement.
