Diminished Earnings owing to Injury

The financial repercussion of being unable to work after an accident can be devastating. This is in addition to the emotional, psychological, and physical burden that victims contend with. Diminished earnings owing to injury refers to decreased income that affects your ability to continue doing your current job and/or robs you of career prospects for the future.

Those who experience diminished earnings owing to injury, usually experience:

o  Reduction in the hours or work a lower pay job because of your impairment

o  Difficulty performing the same type of work that you used to do before the injury

o   No longer have the option to do certain types of work because of the injury.

  • The injury must impact your ability to earn money for you to get compensation for decreased earning potential. In some cases, the injury directly affects a person’s job, but you do not have to be doing a specific job to have suffered diminished earnings.
  • At Juzkiw Law, our team understands how difficult it can be to plan and move on with your life after an accident. This is especially true when your injuries prevent you from working. Our legal team will assist in seeking compensation for diminished earnings owing to injury.

Income Replacement Benefits (IRBs) After a Motor Vehicle Accident

  • Income Replacement Benefits under a standard insurance policy  are available to those who have sustained injuries from a motor vehicle accident. In general, if you were employed when you were involved in an accident, you may receive income replacement benefits, depending on the policy and/or varying law. You may receive up to $400.00 per week. If one has purchased additional optional benefit coverage through their insurance provider, they may be eligible for additional income replacement benefits above and beyond the $400.00 per week provided for under standard insurance.
  • If your injury prevents you from returning to your job and you require retraining for another type of job, then our team can advocate on your behalf to your insurance company to consider covering the cost of your re-education or retraining program. This benefit will allow you to regain your quality of life and successfully reintegrate into a suitable workplace environment.
  • If your inability to work lasts longer than 104 weeks, then the minimum you would qualify for is  $185.00 per week. Applying and qualifying for a Canada Pension Plan (CPP) Disability benefit can be advantageous to qualifying for the pre and post 104 weeks – weekly income replacement benefits from your insurance company. At Juzkiw Law, our team can help you understand your IRB and CPP disability benefit entitlement, as well as what you can expect to receive on a weekly and monthly basis. Results that matter.
